HOA Association Documents

In a community with a Homeowners Association, the governing documents benefit everyone by outlining the terms and conditions, by-laws and rules and regulations for residents, tenants and guests to follow. At Mandalay, those documents give the responsibility and accountability for applying and interpreting the rules to the Board of Directors, which is elected by the homeowners.

In order to be a recognized homeowners association, the association must be a Florida corporation. To be official, the governing documents must be recorded with the Clerk of the County Court. The documents for Mandalay Homeowners Association, Inc. (Mandalay) can be found on this page.

Florida Statutes

Homeowners associations in the State of Florida are governed by two primary statutes, which can be found through the links below. As protection to Florida homeowner communities, all persons serving as directors are required to become certified in basic knowledge of the statutes as part of their fiduciary duty as a director.

Governing Documents

As a deed restricted community, all residents agreed to follow the governing documents when they purchased homes in Mandalay. The four governing documents for Mandalay are the Declaration of Covenants, Conditions and Restrictions (with Amendments 1-7), Mandalay Association By-Laws, Mandalay Association Articles of Incorporation and Rules & Regulations.

The DCCRs recorded in 2004 apply to all Mandalay lots. After the DCCRs was recorded it was amended seven times. Amendment 4 is one of the most significant changes because it addresses changes in Article III and VI of the DCCRs. In April 2023 Amendment #7 was passed by Mandalay homeowners to limit short-term rentals within the community.
